Understanding Aggravated Assault Charges in Tennessee

Aggravated assault is a felony under Tennessee Code Annotated § 39-13-102. What separates it from simple assault is a set of aggravating circumstances: using or displaying a deadly weapon, causing serious bodily injury, committing strangulation, or assaulting someone in violation of a court order or probation agreement prohibiting contact with the victim. Each of those factors affects how a prosecutor charges the case and what penalties the court can impose.

Felony Classifications & Sentencing Ranges

Depending on the circumstances, aggravated assault is charged as either a Class C felony, carrying three to 15 years in prison and fines up to $10,000, or a Class D felony, carrying two to 12 years and fines up to $5,000. When the assault is committed against a first responder, healthcare provider, or utility employee in the discharge of their official duties, the maximum fine increases to $15,000. A conviction also carries consequences that reach well beyond the sentence: loss of firearms rights, restrictions on employment and professional licenses, and limits on housing eligibility.
