What Is an Uncontested Divorce?
In a contested divorce, spouses can’t agree on one or more major issues and must resolve those disputes through court proceedings. An uncontested divorce is different: both spouses have already reached agreement on all the key terms. In Tennessee, these cases are typically filed on the grounds of irreconcilable differences.
Because there’s no need for prolonged litigation, uncontested divorces tend to conclude faster and at lower cost than contested ones. They can also spare both parties the emotional strain that contested proceedings often bring.

The Uncontested Divorce Process in Tennessee
Understanding the required steps before you file helps avoid delays and keeps the process moving. Here’s how an uncontested divorce typically proceeds in Montgomery County.
Residency Requirement
At least one spouse must have lived in Tennessee for a minimum of six months before filing. This is a threshold requirement, not a technicality, and must be confirmed before the case begins.
Required Documents
Three core documents are generally required to file an uncontested divorce in Tennessee:
- Complaint for Divorce: This document identifies the parties, states the date of marriage, and sets out the grounds for divorce, typically irreconcilable differences in an uncontested case.
- Marital Dissolution Agreement: This agreement covers the division of assets and debts, alimony, child custody, and child support. It must be fair to both parties and submitted to the court for approval.
- Parenting Plan: Required when minor children are involved, this document addresses custody arrangements, visitation schedules, and child support obligations.
Filing, Fees & Service of Process
Once documents are prepared, they’re filed with the Montgomery County Circuit Court, and applicable fees are paid. The non-filing spouse is then formally notified through service of process. In uncontested cases, the other spouse typically accepts voluntarily, which can speed things along. Under Tennessee law, when a signed Marital Dissolution Agreement is filed, the defendant may also waive service of process and the requirement to file a formal answer.
Mandatory Waiting Period
Tennessee law requires a waiting period before the case can be heard. Under T.C.A. 36-4-101(b), couples with no unmarried children under 18 must wait 60 days from the date the complaint is filed. Couples who have an unmarried child under 18 must wait 90 days. This period can’t be waived.
The Final Hearing
After the waiting period, the case is scheduled before a judge in the Montgomery County Circuit Court. In most uncontested cases, both spouses appear and may be asked routine questions about the agreement. In certain circumstances, such as when the defendant has waived service of process and the requirement to answer under T.C.A. 36-4-103, only the filing spouse may need to appear. Once the judge is satisfied that the agreement is fair and legally compliant, the divorce decree is finalized.
