Modifying a Parenting Plan in Tennessee

You need a court order to modify a parenting plan. For a judge to rule in favor of the parent seeking modification, he/she must demonstrate that there is a “material change in circumstances,” whether it’s from the parents’ lives or the child’s life. The change needs to be substantial in regard to employment, time, health, age development, etc.

The following are common substantial changes in circumstances to modify a parenting plan in Tennessee:

  • A parent wishes to relocate because of a better job opportunity

  • A parent’s work schedule or living conditions change

  • The child is older

  • The child’s residence is unsafe due to abuse, neglect, substance abuse, etc.

  • One parent continuously ignores the parenting plan

You must also prove that the modified parenting plan will serve the best interests of the child. Parents should have documents to demonstrate the change in circumstance and explain how the change will benefit the child.

Common types of documents include:

  • Evidence of new job

  • New school or extracurricular activity schedules that affect the parenting schedule

  • Notes of actual parenting time in comparison to scheduled time

  • Journal entries of issues with the plan

  • Paperwork of a parent’s unfit behavior

  • Statements from teachers, doctors, and other important figures in the child’s life

  • Statements from older children

Parents must submit the modified plan to the court for approval or ratification. Parents who cannot agree on a revised plan must participate in mediation in order to reach an agreement. If parents cannot find common ground through mediation, the court will ultimately decide.
